 THE OFFICE BEARERS OF THE CHHATTISGARH STATE BAR COUNCIL

The Bar Council shall be constituted by the Chairman, Vice-Chairman,  Treasurer and others Members of the Council duly elected by an electoral  college of Advocates of State including the Advocate General of the State (Ex.- Officio Member of the Council). 

President and Members of various Committees constituted by the Council for  the discharge of specified functions and for achievement of the objectives and  also Representative of the Bar Council of India elected under section 3 of the  Act and two other Members elected under Rule 44.A of the Bar Council of India  Rule. 

Tenure 

(i) The Chairman, Vice-Chairman, Treasurer shall hold Office for two and half (2½)  years or till they cease to be Members of the Council whichever is earlier. (ii) The President and Member of all the Committees formed under the Council  shall hold Office for two and half (2½) years or till they cease to be Members of  the Council whichever is earlier. 

No Confidence Motion:- The Chairman, Vice-Chairman or the Treasurer of the  Council could be removed by a vote of no confidence motion passed by  Three/Fourth (¾) majority in a Meeting of Members and voting in a Meeting of  the Council especially called for the purpose provided that at least Nine (9)  Members of the Council shall have signed the requisition for holding such a  special Meeting and such Meeting shall be called within a period of Twenty One  (21) days from the date of receipt of the requisition by the Secretary. 

Reconstitution of a Committee :- A Committee shall be Reconstituted if not lees  then Nine (9) Members of the Council make a resolution for that purpose duly  signed by them and send it to the Secretary. The Secretary shall call for a  special Meeting within Twenty-One (21) days from the date of receipt of the  requisition for reconstitution of the Committee by the Council and shall notify  the reconstitution of the Committee forthwith by publishing the same.

POWERS AND DUTIES OF THE EXCECUTIVES

(Rule under section 15(2)(g) of the Act.) 

CHAIRMAN 

Save as otherwise provide d in the Act and/or in the Rules made under  the Act, the Chairman shall exercise a general control and supervision  over all matters of the Council. 


  • The Chairman shall preside over all Meeting of the Council.
  • The Chairman may call for a Meeting of the Council on receipt of a  requisition signed by not less than five Members of the Council. 
  • The Chairman shall exercise a casting vote at all Meetings of the Council  in case of equality of votes on any proposal discussed by the Council.
  • The decision of the Chairman, on all points of order raised at any  Meeting shall be final. 
  • The Accountant/Secretary of the Council shall disburse the salaries of  the staff of the Council on the authority of the Chairman, who authorizes  the incurring of routine expenses of the Council. 
  • The payment for the aforesaid purpose shall be made through cheque  drawn by the Chairman himself and countersigned by the Treasurer.
  • The Chairman shall perform such other functions as may be delegated or  assigned to him by the Council. 
  • The Chairman shall co-ordinate the functioning of the Council, staff of  the Council as well as the various Committees formed by the Council in  the discharge of their duties, smoothly by mutual accord, co-operation  and fellow feelings. 

VICE-CHAIRMAN 

The Vice–Chairman may perform such function and discharge such duties as  may be delegated to him by the Chairman and shall also exercise all the powers and discharge all other duties of the Chairman in absence or in the event of Chairman’s  inability to exercise or discharge his duties. 

TREASURER  

(i) The Treasurer along with the Chairman shall make payment of the salaries of  the staff of the Council and authorize for incurring of routine expenses of the  Council by countersigning the cheques for the aforesaid purpose. 

(ii) The Treasurer of the Council alongwith the signature of the Chairman or Vice Chairman shall sign every cheque of the Council. 

(iii) The Treasurer shall receive all money on behalf of the Council and shall make  disbursement as directed by the Chairman or Vice-Chairman, according to their  respective powers conferred on them by the Rules and resolution of the  Executive Committee and the Council. 

(iv) The Treasure of the Council shall be the Ex.-Officio Member of the Finance  Committee of the Council.
