COMMITTEES AT CHHATTISGARH STATE BAR COUNCIL


LEGISLATION & LAW REFORMS COMMITTEE

                It shall be the duty of the legislation and Law reforms Committee to examine  the provisions of all the Laws, bills, proposed Rules and byelaws, ordinances and  regulation from time to time and shall report its opinion to the Council. It shall also  deal with the reference received by the Council for eliciting opinion on all questions of  Law and legislation. 

PRIVILEGES COMMITTEE 

The privileges Committee shall take up all matters in which the rights  privileges and interest of Advocates are involved and communicate its decision as to  the steps required for the redressal by the Council. The Secretary of the Council, on  receipt of any such reports shall immediately communicate the same to all Members  for their opinion and action. The communication so made to the Committee or the  Council by any Advocate shall be treated as absolutely confidential. 


ADVOCATE WELFARE FUND COMMITTEE 

APPLICATION: Rules 65 to 68 shall govern the conduct of the business of the Advocate welfare  Committee. 

FUNCTION: -The Advocate welfare fund Committee shall perform the following functions: 

To ensure group insurance of the practicing Advocates and prepare Schemes for  the followings: - 

(i) To Grant gratuity and retirement facilities to the Advocates enrolled and  participating for such scheme. 


(ii) To sanction financial aid to the junior Advocates by way of stipend on nominal  interest, payable in easy installment to give guarantee for advance of such loan  to the junior Advocates by financial institutions.

 

(iii) To provide for medical insurance to the Advocates. 


(iv) To facilitate house building loans to the Advocates. 


(v) To grant other welfare or benefits like purchasing Law books for establishment  of a library to the junior Advocate. 


(vi) To provide CHAMBERS to the practicing Lawyer of the High Court within the  High court premises of Bilaspur on such terms as determined by the Bar  Council. 


(vii) To provide fund for the establishment of Bar Library at the District, Tehsil head  quarters on such term as decided by the Committee. 


(viii) To grant financial aid to the Members of the Bar for their medical treatment in  case of their serious illness or their physical incapacity incurred by them due to  unforeseen calamity sudden accident or the like. 

MEETINGS The Chairman shall direct the Secretary to convene such Meeting of the  Advocate welfare fund Committee as he deems fit for the disposal of the business  required to be transacted by the Committee, whereupon the Secretary shall convene  such meeting as quickly as possible. 

QUORUM: - Three Members present shall form a quorum for all the Meetings of the  Advocate Welfare Fund Committee and no business shall be transacted at any Meeting  in the absence of quorum. 


APPEAL COMMITTEE 

APPLICATION: - The Rules 69 to 72 shall govern the conduct of the business of the Appeal  Committee. 

FUNCTION: The Committee may entertain an appeal preferred by an aggrieved Advocate  against any decision taken by the Bar against him, in respect of any election at the  Bar or any other conduct and punishment thereon to the aggrieved Advocate on any  account whatsoever. 

MEETING: The Chairman shall direct the Secretary to convene such Meeting of the Appeal  Committee as he deems fit for the disposal of the business required to be transacted  by the Committee, whereupon the Secretary shall convene such meeting as quickly as  possible. 

QUORUM: - Two Members present shall form a quorum for all the Meetings of the Appeal  Committee and no business shall be transacted at any Meeting in the absence of  quorum. 


RECOGNITION COMMITTEE 

APPLICATION: - The Rules 73 to 76 shall govern the conduct of the business of the recognition  Committee.

FUNCTION: - 

(i) The Recognition Committee shall recognize all Bar Associations existing  within its preview at District and Tehsil Level under the provisions of  Chapter V- Bar Association its Registration Duties and Functions set forth in the Chhattisgarh Adhivakta Kalayan Nidhi Adhiniyam 1982. (Act  No. 9 of 1982) 

(ii) The Recognition Committee shall frame Rules for action to be taken  against Bar association functioning in contravention of the Act and their  constitutions or the Rules framed there under. 

(iii) The Recognition Committee shall determine the amount of fee to be  levied from the constituent Bar Associations for their recognition under  the Rules framed by the Council. 

(iv) The Recognition Committee shall determine the amount of fee required to  be paid to the Council for their recognition and validation.

The Chairman shall direct the Secretary to convene such Meeting of the  Recognition Committee as he deems fit for the disposal of the business required to be  transacted by the Committee, whereupon the Secretary shall convene such meeting as  quickly as possible. 

QUORUM: - Three Members present shall form a quorum for all the Meetings of the  Recognition Committee and no business shall be transacted at any Meeting in the  absence of such quorum. 


 AD-HOC COMMITTEE

Any other Committee appointed by Council shall follow as far as may be the  procedure prescribed in these Rules and shall have such powers and duties as may be  assigned to it by the Council.
