THE CHHATTISGARH STATE BAR COUNCIL EXECUTIVE COMMITTEE

APPLICATION OF RULES: - 

The Rule 27 to 41 hereunder shall govern the business of the Executive  Committee. 

FUNCTION OF THE EXECUTIVE COMMITTEE: 

(i) The Executive power of the Council shall vest in the Executive Committee,  which in exercise of its power shall perform all the function assigned to it by the  Council and by these Rules. 

(ii) The Executive Committee shall have power to levy Charges/Fees for its  Financial Management and other Expenses as per schedule of fees and charges  as may be in force from time to time. 

ADOPTATION OF FUNCTION OF CERTAIN COMMITTEES:- Unless otherwise provided in the Act and Rules, if any Committee except the  disciplinary Committee and the Enrolment Committee elected by the Council ceases to  function for any reason, the Executive Committee shall discharge all its functions and  exercise all its powers till formations of a new Committee constituted by the Council in  accordance with the Act and the Rules framed there under. 

POWERS TO APPOINT MEMBERS OF THE STAFF etc: - 

The Executive Committee shall have the power to appoint, promote, punish and  discharge or dismiss any employee of the Council except the Secretary in the manner  prescribed by the Rules framed by the Council. 

The President of the Executive Committee of the Council shall direct the  Secretary of the Bar Council to conduct all the official correspondence of the Council,  to issue all notices as required by the Act or under any of the Rules made there under  to keep minutes books, to supervise the work of the office of the Council, to grant  copies of such documents as permitted by him to certify them to be correct, to allow  inspection of such records as permitted by him by a general or special order and to  keep in his custody the records, library, common seal and such other property of the  State Bar Council as he may possess from time to time and to maintain accurate  books of account in the prescribed form and such other records. 

CONTROL OVER THE STAFF: - 

The Executive Committee shall exercise full control over all the employee of the  State Bar Council and shall determine all questions relating to the eligibility of  promotion, gratuity, provident fund, pensions and all other questions relating to their  employment and prescribe Terms and Conditions under the Rules framed by the  Committee in this behalf with the approval of the Council.  


POWER TO SANCTION LEAVE: -Not withstanding anything contained in the Rules, President Executive  Committee or the Secretary of the Council shall have the power to grant leave to the  employee of the Council to which they may be entitled. 

Chairman or Ex. President Executive Committee shall have the power to grant  leave to the Secretary.  

MEETING: - 

The Executive Committee shall meet at least once in three month except during  High Court vacation unless the President in his discretion directs otherwise in respect  of any particular Meeting. 

QUORUM: - 

In all the Meetings of the Executive Committee three Members shall form a  quorum and in the absence of such a quorum no business shall be transacted at any  Meeting. 

The Executive Committee shall have the power to spend a sum of Rupees Fifteen  Thousand (Rs. 15000/-) per month for any unforeseen purpose out of the budget and  the President shall report such expenditure to the State bar Council at its next  following Meetings. 

PAYMENT:

All the payments to be made by the Council shall be made after the sanctions  provided to them by the Executive Committee, but the President shall have the powers  to order the payment of a sum not exceeding Rupees Fifteen Thousand (Rs. 15000/-)  in any month in anticipation of the sanction of the Executive Committee. 

BUDGET: - 

The Executive Committee, shall upon receipt from the finance Committee,  present the budget of Income & Expenditure of the Council for the next following  financial year before the Council prior to the close of the current financial year. 

SUPPLEMENTRY GRANTS: - 

The Executive Committee may present to the Council supplementary demands  for grant of any sum during the course of the financial year. 

EXTRA ORDINARY MEETING: - 

The President of the Executive Committee shall call the Committee Meeting  within 48 hours of the receipt of a written requisition for such Meeting by any four  Members of the Committee which shall contain the business proposed to be  transacted at such Meeting and shall state the ground of urgency for such Meeting. No  business other than that proposed Agenda shall be transacted in this Meeting. 

PROCEEDINGS OF OTHER COMMITTEES: - 

The Executive Committee may peruse the proceedings of any Committee other  than the disciplinary Committee and enrolment Committee and it may invite its  attention to the proceeding in respect of its propriety.
