RULES OF MEETING OF THE CHHATTISGARH STATE BAR COUNCIL

(Rules Section 15(2)(h)&(j) of the State Bar Council of C.G.)

First Meeting of the Council After elections of the state Council under section (8) of the Act are held, the first  Meeting of the Council shall be called as far as possible within 30 days from the  date of declaration of the results of the election to elect the Chairman and Vice Chairman of the Council. A notice of at least Twenty One (21) days shall be  given for the general Meeting to be held for this purpose. The notice of the  Meeting shall be sent by hand delivery or Registered Post or Courier Service.  The first Meeting of Council shall be presided over by the Advocate- General,  but if for some reasons the Advocate - General does not attend the Meeting,  then the Council shall appoint any one of the Members, who is not a candidate  for the election of Chairman or Vice-Chairman, to preside over the Meeting. 

(MEETINGS: - 

(a) Ordinarily, there shall be 6 Meetings of the Council in a year. (b) The Meeting of the Council may be adjourned from day-to-day or any  particular convenient day without further notice. 

Meeting of the Council shall be convened by the Secretary under the  direction of the Chairman, who shall determine the time and place there  of provided that no Meeting shall ordinarily be convened for any date  during the summer vacation of the High-Court. 

The Secretary shall, in consultation with Chairman, circulate the  agenda of the general Meeting, intimating the proposed date, time and  place of such Meeting at least Ten (10) days before the Meeting. The  notice of Meeting shall be dispatched by hand delivery or Registered Post  or Courier Service. 

Chairman shall convene an extra ordinary Meeting of the Council  on a requisition in writing singed by not less than Seven (7) Members of  the Council. 

AGENDA.:- The Chairman shall settle the Agenda for the aforesaid Meeting of the Council.

QUORUM :- 

The quorum for a Meeting of the Council shall be Eleven(11). If the Meeting is however adjourned for want of quorum the adjourned Meeting  shall be held Fifteen (15) minutes thereafter on the same day, if this fact is mentioned in the notice for convening the Meeting and for such Meeting the Members present  shall form the quorum. In the adjourned Meeting no business which has not been included in the  Agenda of the Meeting shall be transacted. 

TRANSACTION OF BUSINESS IN MEETING:- 

(A) Resolutions of the Council shall ordinarily be decided by show of hands unless  five of the Members present make a request for voting by ballot or any  particular method. Each Member of the Council shall have one vote or incase  the votes are equal, the Chairman shall have a casting vote. 

(B) If any Member present in the Meeting raises a point of order, it shall be  considered and recorded in the Minute Book. The decision of the Chairman on  them shall be final which is reduced in writing. 

(C) Any business of the Council may be transacted by circulation on a reference by  the Chairman provided that any three Members may require any such items of  business to be transacted only at a Meeting of the Council and such items shall  be transacted accordingly. 

(D) If an urgent action by the Council is deemed necessary, the Chairman of the Council may permit the same to be transacted by circulation of the papers to  the Members of the Council. The action proposed to be taken in such a Meeting  shall not be taken unless agreed to by a majority of Members of the Council.  The action so taken shall be forth-with intimated to all the Members of the  Council. The papers regarding this shall be placed before the next following  Meeting of the Council for confirmation. 

(E) The decision of the Chairman on all point of order raised in the Meeting shall be  final. 


TRAVELLING ALLOWANCE TO MEMBER FOR ATTENDING THE MEETING

A Member of the Council or any other Committee or Election Tribunal or any  Tribunal constituted under the Advocates Act 1961 and the Rules there under  attending the Meeting shall be entitled to traveling allowance of Ac-II class fare and in  case of travel by car, Rupees Three (Rs. 3/-) per kilo meter, from the place of ordinary  residence to the place of the Meeting and the same rate of payment for his return  journey. 

Members of the Council, Committee, Election Tribunal or any other Tribunal  constituted under the Act and the Rules made there under attending a Meeting at a  given place shall be allowed daily allowance of Rupees Three Hundred (Rs. 300/-) per  day, the same being admissible only for the days on which such Member attends the  Meeting provided that, if two or more Meetings are held on the same date only one  such daily allowance shall be permissible to such a Member. 

On receipt of a notice for holding an extra ordinary Meeting of the Council the  Secretary shall issue a notice for the same fixing a date for the Meeting not latter than  three weeks from the date of receipt of the requisition and the agenda of such Meeting  shall include the items mentioned in the same apart from any other item of the agenda  may be placed before the Meeting for consideration. 

PROCEDURE OF CONDUCT OF MEETING 

(a) A Member attending the Meeting of the Council shall address the chair while  speaking and he shall be entitled to speak only once on each subject, unless  otherwise required or permitted by the chairman to do so. 

(b) Unless otherwise provided in these Rules, the decision on any matter shall be  by majority and in case of equality, the Chairman of the Meeting shall have a  second or casting vote. 

(c) No matter once decided shall be re-considered for a period of 3 months unless  the Council by a two third majority of the Members present so permit. (d) In the absence of the chairman and the vice-chairman at any Meeting of the  Council, a Member chosen amongst the Members present at the Meeting may  preside.
